In a dramatic turn of events, Mr. Ewelike Samuel, a dedicated public servant with the Federal Fire Service (FFS), has emerged victorious as the Federal Capital Territory (FCT) High Court, Zuba, discharged and acquitted him on eight counts of theft and criminal breach of trust. Samuel, who steadfastly pleaded not guilty throughout the trial, now walks away cleared of all accusations.
Justice Kezziah Ogbonnaya, in delivering the momentous judgment, underscored the principle that the court could not, in good conscience, convict based on unsubstantiated allegations, as doing so would compromise the very essence of justice. The prosecution’s case crumbled under scrutiny as they failed to provide crucial evidence, notably the vehicle license with the chassis number, necessary for the court to verify the identity of the allegedly recovered vehicle in Kogi State.
Furthermore, the court found no concrete evidence linking Samuel to the individuals discovered with the stolen vehicle. In a resounding declaration, Justice Ogbonnaya proclaimed, “The court, however, discharges and acquits the defendant of all the crimes against him.” This verdict not only exonerates Samuel but also serves as a powerful affirmation of the presumption of innocence until proven guilty.
Not stopping at mere acquittal, Justice Ogbonnaya issued a compelling order for the FFS to reinstate Samuel promptly. The court mandated the reinstatement to include the restoration of all allowances, salaries, and promotions dating back to 2013, ensuring that Samuel’s professional standing is fully vindicated.
The Prosecution Counsel, Baguda Sani, had leveled serious allegations against Samuel, accusing him of unlawfully moving and disposing of FFS vehicles while allegedly abetting others in their unauthorized use. However, the court’s meticulous examination of the evidence laid bare the prosecution’s inability to establish the charges against the resilient defendant.
As the legal storm subsides, Ewelike Samuel stands not only as an innocent man but as a symbol of resilience against unjust accusations. The Federal Fire Service is now tasked with reinstating their dedicated employee, providing a glimmer of hope in a story that exemplifies the triumph of truth and justice.
