‘Filed Out of Time’ — EFCC Withdraws Appeal Against Order Restraining Yahaya Bello’s Arrest

The Economic and Financial Crimes Commission (EFCC) has filed a notice to withdraw its appeal against an order of a Kogi high court that restrained the agency from arresting Yahaya Bello, the former governor of the state. The notice of withdrawal, filed on April 22, was based on the fact that events had overtaken the appeal.

The EFCC admitted that the appeal was filed out of the time allowed by law. The notice read that the appellant intended to withdraw the appeal against the respondent in the above-mentioned appeal. The notice was predicated on the fact that on April 17, 2024, the application filed by the appellant was overtaken by the decision of the Kogi state high court.

The EFCC further stated that the orders made ex parte by the high court on February 9, 2024, were made to last pending the hearing and determination of the originating motion on notice, which was finally determined by the same court on April 17, 2024. Additionally, the notice of appeal was filed out of time, and the EFCC prayed that the appeal be struck out for being filed out of time and incompetent
