Court dismisses suit challenging Tinubu-Shettima

On May 26, 2023, the Supreme Court dismissed a lawsuit seeking to disqualify President-elect Bola Tinubu and Vice President-elect Kashim for alleged double nomination in the 2023 presidential election.

The court ruled unanimously that the suit lacked merit since Kashim had withdrawn his nomination as senator for Borno Central District in July and had been substituted as vice president.

The court also agreed with the lower court that the opposition party, PDP, lacked the standing to bring the case and acted as a busybody in interfering with the APC’s internal affairs.

The PDP was ordered to pay a sum of two million naira.

The PDP had alleged that Shettima had a double nomination as senatorial candidate and vice presidential candidate, but the Federal High Court and Court of Appeal had previously dismissed the appeal.
