Edo 2020: Appeal Court repeals judgment disqualifying Ize-Iyamu, Audu

A Court of Appeal sitting in Benin, Edo state, on Monday set aside the judgment of the Edo State High Court disqualifying Gani Audu and Pastor Osagie Ize- Iyamu from contesting in the September 19, 2020 Governorship election in the State.

Recall that the Peoples Democratic Party (PDP) had earlier filed a suit against Audu, stating that he was not qualified to contest the election on the grounds that he submitted false information to the Independent National Electoral Commission (INEC).

However, delivering judgment, judges O. F. Omoleye, B. A. Georgewill and O. E. Oho said there is no evidence of credentials forgery on the part of Gani Audu and the claims concerning the differences in the spelling of names are not enough proof.

The appellate court declared that the matter was statute-barred, having been filed outside the 14-day constitutional threshold.
