Applicants Sue Buratai, Army For Illegal Detention

Two Nigerians, Ibrahim Shehu Damakosu and Sabo Yahaya have sued the Chief of Army Staff, Lt General Tukur Buratai, General Officer Commanding 7 Division, Nigeria Army, and Attorney General and Minister of Justice at the Federal High Court of Nigeria, Maiduguri over their illegal detention and also the violation of their fundamental human rights pursuant to Section 46(3) of the 1999 Constitution as amended in suit No. FHC/MU/CS/1/2021 as filed.

The petitioners are seeking a declaration that their continued detention at the detention cell of the 7 Division, Maimalari Cantonment, Nigerian Army, Maiduguri from 24TH November 2020 up till this moment without bringing them to a capable court for trial is unconstitutional, unlawful, and illegal.

They are asking for an order compelling the respondents to either prosecute the applicants before a competent court of law or immediately discharge them from unlawful detention.

The applicants have also requested for payment of damages to the tune of a N100million, a written expression of regret, and any further orders as the court may consider appropriate.

No particular date has been fixed for the hearing of the suit.
